Punished by a fine up to $10,000 as well as incarceration between 180 days and two years.

3RD DEGREE FELONIES
TEX. PENAL CODE §12.34

Punished by a fine up to $10,000 as well as incarceration between two and ten years.

2ND DEGREE FELONIES
TEX. PENAL CODE §12.33

Punished by a fine up to $10,000 as well as incarceration between two to twenty years.

1ST DEGREE FELONIES
TEX. PENAL CODE §12.32

Punished by a fine up to $10,000 as well as incarceration between five to ninety-nine years/life.

CAPITAL FELONIES
TEX. PENAL CODE §12.31

Punished by life imprisonment without the possibility of parole, or death ("capital punishment").

In Texas, including Dallas-Fort Worth area and Austin, repeat or habitual felony offenders face harsher punishment when convicted for new felony offenses. For example:

  • A person currently charged with a second-degree felony offense who has previously been convicted of a felony offense will now be convicted of a felony in the first degree, resulting in a prison sentence ranging from five to 99 years or life imprisonment and/or a fine of up to $10,000.

  • A person currently charged with a first-degree felony offense who has previously been convicted of a felony offense faces a prison sentence ranging from 15 to 99 years or life imprisonment and/or a fine of up to $10,000.
